Second Offense

- Jail Time: From 180 Days to 2 Years (DWI with a Child under 15 in Vehicle)
- Fine: Up to $4,000
- Fine for a (Child under 15 in Vehicle): Up to $10,000
- DWI Surcharge: $1,500 per Year for 3 Years
- DWI Surcharge for BAC of .16 or Above: $2,000 per Year for 3 Years
- License Suspension: From 180 Days to 2 Years
- Ignition Interlock Device Installed on Vehicle
Third Offense
- Notation on Public Criminal Record
- Jail Time: From 2 to 10 Years
- Fine: Up to $10,000
- License Suspension: From 180 Days to 2 Years
